Preamble
These General Terms and Conditions of Sale (GTCS) apply to all services related to the creation, modification, maintenance, and/or hosting of websites provided by Rémy Got, a self-employed business (micro-entreprise) registered under number SIREN 91277393400035, with its registered office located at 46 rue Mauduit Duplessis, 29900 Concarneau, France.
Mr. Rémy Got declares that he holds a professional liability insurance policy covering all consequences that may arise directly from his professional activities, worldwide, through the company Hiscox, located at 35 avenue Monterey, L-2163 Luxembourg, and registered with the Paris Trade Register under number 833 546 989. The French office is located at 49 avenue de l’Opéra, 75002 Paris.
Article 1: Purpose
These GTCS define the rights and obligations of the parties in the context of the provision of website creation, modification, or maintenance services.
Article 2: Acceptance of the GTCS
Placing an order implies full and unconditional acceptance of these GTCS. They take precedence over any other document, unless explicitly agreed in writing by Rémy Got.
Article 3: Services
The services may include, as specified in the quote:
Website creation (showcase sites, e-commerce, etc.)
Modification of existing websites (design, functionalities, etc.)
Technical and corrective maintenance
Hosting and domain name management (where applicable)
Article 4: Quotes and Orders
A detailed quote will be issued for each service. The order will be confirmed after written acceptance of the quote by the client, accompanied by any deposit defined in the quote.
Article 5: Prices and Payment Terms
Prices are expressed in euros and may include or exclude VAT, depending on Rémy Got’s tax regime.
A deposit of 30% may be required at the time of order.
The remaining balance is payable upon receipt of the final invoice, unless otherwise stated in the quote.
Payments can be made via bank transfer, PayPal, or Stripe.
In the event of late payment, a penalty of 15.21% will be applied from the due date, along with a fixed recovery fee of €40.
Article 6: Execution Deadlines
The execution deadlines indicated in the quote are provided as estimates. Rémy Got undertakes to meet them as far as possible but cannot be held responsible for delays caused by external factors (e.g. delays in content delivery by the client, late changes, etc.).
Article 7: Obligations and Responsibilities
Rémy Got commits to delivering services in accordance with professional standards.
The client is responsible for the content provided (texts, images, videos, etc.) and guarantees that it complies with third-party rights (intellectual property, image rights, etc.).
Rémy Got shall not be held liable for service interruptions or data loss caused by third parties (hosting providers, external services, etc.).
Article 8: Delivery and Validation
Upon completion of the work, a final version will be submitted to the client for approval.
Any major changes requested after validation will be subject to a new quote.
If no feedback is provided within 7 days of delivery, the service will be considered accepted.
Article 9: Maintenance and Support
Maintenance (corrective or adaptive) is optional and subject to a separate agreement, unless otherwise stated in the initial quote.
Article 10: Termination
Each party may terminate the agreement in case of serious breach of the obligations outlined. If the client terminates after work has started, the completed work will be invoiced proportionally.
Article 11: Intellectual Property
Deliverables remain the property of Rémy Got until full payment of services. Once payment is completed, the client is granted the right to use the delivered elements (website, logo, content, etc.).
Article 12: Data Confidentiality
In the course of website creation, modification, correction or any technical intervention on a WordPress site, the provider may handle technical and sometimes personal data (admin access, user content, databases, etc.).
All information transmitted in this context is strictly confidential. It will not be shared or used for any purpose other than the performance of the requested tasks.
The provider commits to not retaining any unnecessary data once the intervention is complete, unless explicitly agreed by the client. Files and access credentials may be deleted upon request.
Article 13: Governing Law and Dispute Resolution
These GTCS are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution before referring the matter to the competent courts of Quimper, France.
